IMPORTANT NOTICE

By requesting Yaomarket ‘s services , you, as the “Sender”, agree on your own behalf, on behalf of the “Recipient” of the Shipment and on behalf of any other person with an interest in the Shipment, that these  Terms and Conditions  apply.

“Shipment” refers to all documents or packages that travel under a single air waybill and that may be transported by any means Yaomarket chooses, including air, land, or other carriers.

A  “guide” includes any Shipment identifier or document generated by Yaomarket’s automated systems or the Sender, such as labels, barcodes, consignment notes, or their electronic versions.

All shipments are transported under  limited liability , unless additional insurance is purchased (see Section 8).


1.  Customs Clearance and Regulatory Compliance

Yaomarket may perform the following actions on behalf of the Sender or Recipient:

  1. Complete documents, correct product or service codes and advance payments of duties, taxes or other regulatory charges (“Customs Duties”).
  2. Act as an authorized agent or appoint a customs agent.
  3. Redirect the shipment to the customs agent or another requested address.

The Sender/Recipient must provide any additional authorization required by law.


2.  Unacceptable Shipments

A shipment is considered unacceptable if:

  • It contains firearms, ammunition, explosives, replica weapons, cash, precious metals, live animals, human remains, illegal drugs, or cannabis products.
  • It is classified as a hazardous or prohibited material according to international regulations (ADR, IATA, ICAO).
  • It cannot be transported safely or legally.
  • The address is incorrect or the packaging is inadequate.
  • The Sender/Recipient is listed on international sanctions lists.

Delivery Time

Shipments are processed on  one business day  and delivered within  24 hours , excluding weekends and holidays.


3.  Deliveries and Non-Deliverable Shipments

  • We do not deliver to P.O. boxes.
  • Delivery is made to the address provided, not necessarily to the recipient personally.
  • If the shipment is unacceptable, undervalued, the recipient is untraceable, or refuses to pay taxes, Yaomarket will attempt to return it at the sender’s expense.
  • If it is not possible to return it, it may be  released, abandoned, destroyed or sold without liability to Yaomarket.

 

4.  Inspection

Yaomarket may open and inspect a shipment without prior notice for security, customs, or other legal obligations.


 

5.  Charges, Taxes and Fees

  • Shipping costs are calculated based on the actual or volumetric weight, whichever is greater.
  • Yaomarket may request payment of taxes or fees before delivery.
  • If the Recipient does not pay, the Sender must refund all applicable charges.

 

6.  Yaomarket’s Responsibility

 

6.1 Limitations of liability:

  • For air shipments: up to  22 Special Drawing Rights (SDR) per kg  (~USD 30/kg).
  • For international ground shipments: up to  8.33 DEG per kg  (~USD 11/kg).
  • Indirect losses (loss of profits, income, etc.) are not covered.
  • If greater coverage is desired,  additional insurance must be requested  (see Section 8).

6.2 Delays:

Yaomarket is not liable for losses due to delays, although in certain cases limited compensation may apply.


 

7.  Claims

Claims must be submitted in writing within  30 days  of acceptance of the shipment. Only one claim per shipment is accepted, and its resolution will be  final and complete .


 

8.  Shipping Insurance

Additional insurance can be purchased   for the full value of the contents, provided the sender indicates this in writing or when completing the waybill. This insurance does not cover indirect damages or damages due to delays.


 

9.  Force Majeure

Yaomarket is not responsible for losses beyond its control, such as:

  • Magnetic damage or data loss.
  • Natural disasters, wars, riots, pandemics.
  • Third-party actions, cyberattacks, or errors by customs authorities.

 

10.  Sender’s Guarantees

The Sender agrees to indemnify Yaomarket in the event of:

  • Shipment not in compliance with the restrictions of Section 2.
  • False or incomplete information about value, content, or recipient.
  • Non-compliance with customs regulations, export regulations, or international sanctions.
  • Disclosure of personal data without consent.

11.  Routes

The Sender agrees that Yaomarket will decide the route and any deviations of the Shipment, including intermediate stops.


 

12.  Applicable Law

Any dispute will be governed by the  law of the country of origin of the shipment , unless otherwise provided by law. The sender agrees to submit to such jurisdiction.


 

13.  Divisibility

If any clause of these Terms and Conditions is deemed invalid, it will not affect the validity of the others.
